Welcome to Blom. By accessing or using our mobile application, you agree to be bound by these Terms of Use. Please read them carefully.
1. Medical Disclaimer
Blom is a generative soundscape tool designed for relaxation and personal well-being.
- Not Medical Advice: The content and data-driven sounds provided by Blom are not intended to be a substitute for professional medical advice, diagnosis, or treatment.
- HealthKit Integration: While Blom utilizes physiological data (such as heart rate) to modulate soundscapes, it is not a medical device. Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition.
- No Emergency Use: Do not use Blom as a biological monitor during medical emergencies or for the treatment of clinical conditions.
2. Description of Service & Personalization Features
Blom provides a living auditory sanctuary by utilizing real-time data to create an ever-evolving sound experience. To provide a fully tailored acoustic environment, you may grant the following personalization permissions:
- Generative Sound Engine: Unlike traditional static loops, Blom uses proprietary algorithms to compose music in real-time. No two listening sessions are ever identical.
- Biometric Personalization (HealthKit): You may grant Blom access to your Apple Health account. The app analyzes physiological metrics, including heart rate, resting heart rate, active energy, sleep patterns, and steps, to personalize the harmonics and tempo of your sound environment.
- Hardware Requirement Notice: Personalizing the sound environment based on your heart rate requires compatible third-party hardware, such as an Apple Watch or other supported sensors. Currently supported devices are listed within the application.
- Geographical Adaptation (Location): To synchronize your experience with the external world, the app may request access to your location data via GPS, Wi-Fi, cellular networks, or device sensors. This allows Blom to fetch local time and weather conditions via Apple WeatherKit.
- Acoustic Personalization: Users can access a professional library of high-fidelity soundscapes designed for various mental states, such as deep relaxation, creative flow, or restorative rest.
- Local Privacy Processing: All feature-related data processing is performed locally on your device to ensure maximum privacy and zero latency.
3. Subscriptions and Billing
Blom offers premium features via Monthly, Annual, or Lifetime subscriptions.
- Apple ID Processing: All purchases are processed through the Apple In-App Purchase system. Your payment is subject to Apple's Media Services Terms and Conditions.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Management: You can manage or cancel your subscription at any time in your Apple ID Account Settings.
- Refunds: All refund requests must be processed by Apple. Please visit reportaproblem.apple.com.
4. Service Modifications and Scope
Blom reserves the right to modify, enhance, or discontinue specific features or services to optimize the user experience.
- Existing Subscriptions: Any such modifications or changes to the service scope will not adversely affect the core functionality of services you have already purchased or subscribed to.
- Basis of Service: The latest service description displayed within the application at the time of your registration or purchase shall serve as the definitive basis for the scope of your specific service.
5. Intellectual Property
- The App: All software, generative algorithms, visual designs, and the Blom brand are the exclusive property of the developer.
- The Soundscapes: The real-time audio generated by Blom is intended for personal, non-commercial use only. You may not record, redistribute, or perform the soundscapes for commercial profit without explicit written consent.
6. User Conduct and Restrictions
By using Blom, you agree not to:
- Attempt to decompile, reverse engineer, or extract the source code of our generative engine.
- Use the app for any illegal or unauthorized purpose.
- Interfere with the local data processing or security features of the application.
7. Privacy and Data Usage
Your use of Blom is also governed by our Privacy Policy. We emphasize that your sensitive biological and geographical data (HealthKit, Location, WeatherKit) are processed locally on your device and are never stored or shared by us for marketing purposes.
8. Limitation of Liability
To the maximum extent permitted by law, Blom and its developers shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the application, including but not limited to reliance on the auditory feedback for health monitoring.
9. Governing Law & Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Blom operates, without regard to its conflict of law provisions.
- Arbitration Agreement: Any dispute or claim relating in any way to your use of Blom will be resolved by binding, individual arbitration, rather than in court.
- Class Action Waiver: You and Blom agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any significant changes by updating the Last Updated date at the top of this document. Continued use of the app after changes constitutes acceptance of the new Terms.
